Stormwater has played a starring role in a number of high profile legal cases within the past year. This presentation will discuss a number of those cases and what they might mean for water resource professionals in the Philadelphia Metropolitan Area. Topics will include: stormwater permit enforcement, regulation of stormwater flow, regulation of stormwater at construction sites, stormwater fees, and stormwater regulatory exemptions. Cases that will be covered include: Los Angeles County Flood Control Dist. v. Natural Resources Defense Council, Inc., No. 11-460 (U.S.); Citizens for Pennsylvania’s Future v. Pittsburgh Water & Sewer Auth., et al., No. 12-943 (W.D. Pa); United States v. Stowe, No. CR12-512RBL (W.D. Wash.); Va. Dep’t of Transp., et al., v. EPA, et al., No. 1:12-CV-775 (E.D. Va.); Wisconsin Builders Ass’n v. EPA, No. 09-4113 (7th Cir.); and Decker, et al. v. Northwest Envtl. Def. Ctr., No. 11-338 (U.S.).

Brian Glass is a partner at Warren Glass LLP, an environmental and water resources law practice. Brian has practiced environmental law for over ten years at private law firms and at a non-governmental organization. Brian began his legal career in the environmental practice groups at two large law firms in Philadelphia, where he represented clients in environmental litigation and counseled clients on regulatory matters and environmental issues in business and real estate transactions. More recently, Brian served as General Counsel for Citizens for Pennsylvania’s Future (PennFuture), a non-governmental organization at which he often sought and achieved common sense solutions to bridge differences between environmental and business interests. While at PennFuture, Brian focused his practice on water quality issues and represented municipal and other clients in numerous environmental litigation matters, including citizen suits and permit appeals. 

Brian has been recognized by his peers for his work on water law, environmental citizen suits, and stormwater issues. For the past several years, Brian has been asked to serve as a panelist on the Water Update at the Pennsylvania Bar Institute’s Environmental Law Forum and to guest lecture on the topic of environmental citizen suits at the Rutgers School of Law in Camden. Brian also has been appointed to numerous state and local agency advisory groups convened to address emerging stormwater issues.
